Article 1, Section 9, Clause 2 - Habeas Corpus:

"The Privilege of the Writ of Habeas Corpus shall not be suspended, unless in cases of rebellion or invasion the public safety may require it."

Some on the Left argue that the Writ of Habeas Corpus has not been suspended; therefore, the approximately 20 million undocumented immigrants who entered the country during the Biden Administration are entitled to a hearing. The question for constitutional lawyers is whether individuals who entered the country illegally?some might describe this as an invasion?have the right to habeas corpus protections.

By deporting undocumented immigrants without providing a hearing for each individual, has the Trump Administration effectively suspended habeas corpus?

Lincoln suspended it in Maryland during the War of Northern Aggression.  Way back then Md had not been convinced enough that being a yankee was a good thing.

They currently are believing in that idea.
